1. User and Membership Eligibility

As a registered Member of our Websites, you are responsible for keeping your password and Membership Account information confidential. You should not provide anyone your Membership Account log-in information. You are responsible for all activities that occur under your Membership Account.
  3. We reserve the right to terminate or suspend your Membership Account at any time for any or no reason. Therefore, you should keep copies and records of any content you may wish to access if your Membership Account is terminated.

You acknowledge and agree that your Submitted Content (i) shall not be considered confidential, proprietary or personal to you or anyone else and (ii) may be disseminated or used by us for any purpose without (a) compensation to you or anyone else or (b) acknowledgement of you or anyone else as the source of such Submitted Content. Therefore, do not send to us or post on our Websites any ideas, materials, suggestions, content or other information you would like to keep confidential or for which you would like or expect acknowledgement or compensation.

o misrepresent(s) you or any third party’s identity, affiliation or connection with a person or entity; o imply(ies) or state(s) that we endorse or are in any way associated with Submitted Content; o contain(s) any false, misleading, deceptive, sexually suggestive, abusive or harassing content; o promote(s) hatred, racism, bigotry, physical violence or emotional abuse against any individual or group; o is unlawful, threatening, defamatory, obscene, libelous, or otherwise contain(s) offensive content; o contain(s) photographs or words containing or depicting objectionable subject matter, including but not limited to photos depicting or containing the following: excessive violence, nudity, obscenity, sexual explicitness, and harassing content; o contain(s) any information or computer code that is intended to, or is likely to, damage, interfere with, alter, intercept or expropriate any data or system, such as Trojan horses, worms, time bombs, cancelbots and other unauthorized computer programming routines; or o contain(s) advertising or solicitation of any kind

(e) We do not guarantee that Submitted Content will not be lost or damaged or that you will be able to retrieve Submitted Content. We reserve the right, but do not have the responsibility, to monitor and remove any Submitted Content, at any time and without notice, in our sole discretion.

5. Ownership and Permitted Use of Content
(a) We, our licensors (including our Members), or other third parties own all content appearing or available on or otherwise making up the Websites (“Content”), including but not limited to all text, Available Features, trademarks, service marks, trade names, logos, icons, domain names, written material, downloadable material, photographs, artwork, computer code, look and feel, trade dress, technical information and advertisements. Such Content is protected under United States’ and other countries’ copyright, trademark and other laws and international treaty provisions, and any unauthorized use by you of this Content may subject you to civil and criminal penalties. The ownership of all Content is retained by its owner.

(d) All rights in and to the Content not expressly granted in these Terms of Use are retained by Malleries.

6. Content Appearing On or Accessed Through the Websites
(a) We do not independently verify any Content appearing on or accessed through the Websites that has been provided by third parties (such third parties “Content Providers”), including, but not limited to, Content provided by third parties having an agreement with us to provide content for or to be accessed through the Website or Content provided by third parties not having an agreement with us to provide content for or to be accessed through the Websites. We do not guarantee or warrant that any Content appearing on or accessed through the Websites (including that Content provided directly by us) is accurate, complete, truthful, or non-objectionable. We do, however, take reasonable efforts to ensure Content prepared directly by us, including but not limited to product and services descriptions, is accurate, timely and complete.

(b) We reserve the right, at any time and in our sole discretion, to remove any Content from the Websites without notice.

11. General Practices Regarding Use and Storage
Malleries reserves the right to establish general practices and limits concerning use of, and storage space on, our servers.

The Items and other products depicted on the Websites are available only while supplies last. Malleries reserves the right to discontinue the Websites or any Available Features or providing any product or services at any time, without notice. Though we make a conscientious effort to display and describe the Available Features accurately and completely, we cannot and do not guarantee that the Available Features, including but not limited to, product images and description, services and service descriptions or specifications displayed or described to you on or through the Website are or will remain accurate in every detail. The detail and accuracy of the image and specifications of Items and other products available through the Websites will depend on a number of things, including your computer equipment and Internet connections. In addition, we are constantly updating the Available Features in response to the requests from users and advancements made in the industry. Release Of Claims


Malleries LLC and associated sites acts as the venue for Sellers to conduct sales and for Buyers to purchase Sellers' items. We are not involved in the actual transaction between Sellers and Buyers. We are not responsible for addressing any disputes between any sellers or between sellers and buyers. In the event you have a dispute with another Seller or with a Buyer, sellers shall communicate directly with the other party in resolving the concern, claim or dispute. In the event you have a claim or dispute, you hereby release Malleries (and our directors, officers, agents and employees) from any and all claims, demands and damages (actual and consequential) of every kind arising out of or in any way connected with such disputes. You agree to indemnify and hold harmless Malleries and our affiliates officers and employees from and against any and all claims, liability, loss, damage and expense.

Malleries LLC specifically disclaims any implied warranties on title, merchantability, fitness for particular purpose and non infringement. Malleries LLC entire liability to you or any third parties under any circumstances is limited to $100 per item.

Sellers acknowledge that shop and hosting services provided by Malleries LLC in which seller takes part in may not be PCI Compliant. Seller acknowledges and understands that Malleries LLC prohibits storing any sensitive information to include but not limited to credit card numbers at any time on the Malleries web site and owned an operated by Malleries LLC or hosting server company in which Malleries LLC.

If seller chooses to store sensitive information and or any or all of the information is compromised, seller agrees to indemnify and hold harmless from all claims, losses, expense, fees including attorney fees, cost and judgments that may be asserted against Malleries LLC or website hosting service company.

    A. Shop Owners must have the legal capacity to enter into binding contracts.

    E. Shop owners do not purchase rights to or ownership of programming, format, design, features, capabilities, disk space or other assets from Malleries.

Fine Textiles are at the highest end of the market in terms of quality and condition. The items listed in this category should be typically hard to obtain and price is a factor. Acceptable items for the Fine Textiles category listed below.

Fine period brocades, cashmere, Italian lace or linen, silks, Irish linen, hand-finished wool, Normandy lace and other fine fabrics are considered acceptable. Textile must be in good to excellent condition. Tattered textiles or fabrics are not acceptable for the Fine Linens Textiles category.

Fine Art
Fine Art representing local, national and international artists of all periods. Reproductions, fakes, copies or poor quality art is not acceptable in this category. Only original works, prints, traditional paintings, impressionistic oils, abstract watercolors, mixed media, contemporary spiritually inspired art. Art must be represented for what it is, for example; in the manner of, in the style of, or by the original artist.
    Paintings: Fine Art including paintings pre 1900s.
    Religious Art: Art that depicts biblical themes including iconic art.

Malleries is a pre-screened Mall site that is committed to a rigid ZERO-TOLERANCE counterfeit policy. Reproductions, fakes or copies are not acceptable in this category and will be deleted from the site. Our goal is to maintain the highest quality standards providing our shop owners with a reputable venue to sell their authentic Luxury Goods. To list in Malleries Luxury Goods category a seller must:

To sell within the Luxury Goods Category the seller must meet the following qualifications:
    1. Sell Authentic Luxury Goods Only. Sellers of Non-authentic luxury will automatically be rejected.
    2. All Luxury shop owners MUST possesses a very strict anti-counterfeit philosophy.
    3. Possess an excellent ebay feedback or reputation via referrals.
    4. Item images must comply with our Image Policy.

On occasion and without prior notice, Luxury good items are monitored by an expert in the field to maintain our strict anti-counterfeit policies. Any Luxury itemed suspected to be counterfeit will be placed in the back room. The shop owner must have the item authenticated and send proof of authentification before the item is made available to the public and re-listed.

A shop owner found to list couterfeit luxury items will be placed under suspension and will be fined $200.00. Once the fine is paid the review process begins. If shop is authorized to re-open the shop owner will be notified by email and the shop will become live and viewable to the public. The shop will not re-open until fine is paid in full. NOTE: The decision to reopen is at Malleries discretion.

Acceptable Designer Names:
Luxury good are classified as items of the highest end of the market in terms of quality, condition and price. A luxury item is typically expensive and hard to obtain. Examples of Luxury Goods include Luxury bags from a well recognized high quality designer name: Specific Cartier, Chanel, Louis Vuitton, Gucci, Christian Dior, Hermes and other categories listed at Malleries. To list items in the Other Designer category must be approved. Examples of designers that will not be approved are Coach, Isabelle Fiori. Please submit for aproval before listing.

Authentication Images:
All items must include sharp clear images to show authenticity such as images of the serial numbers, corresponding with the authenticity card, hardware, logo, stickers, date codes, registration stamps, heat stamps etc. Blurry authentication images are not acceptable. Items without the appropriate authentication images will be placed in the backroom.

In addition to the Image Policy, Image background must be a professional photographic paper or muslim backdrop (available at any photography shop). Wrinkled sheets, cloths of any type are not acceptable.

Items listed in the Luxury category can be newer or vintage. All items must always be in good to excellent condition.

Overwriting Previous Listings:
Overwriting previously listed items with newly listed items is prohibited. Shop owners who are found guilty of violating this policy may be placed under suspension.

Sold Via Malleries:
Items that are sold via Malleries are to remain listed and viewable to the public until the seller recieves the item.

It is prohibited to include any outbound links to any other venue other then Malleries in emails or auto-responses. Malleries is not to be used to redirect customers to other sites. Auto-responders should include links only to their shop on Malleries within the email signature.

Item Titles
Your Item Title is an opportunity to capture the interest of customers at the same time it is the most important Search Engine Optimization factor. Writing a good item title using important keywords relevant to your item listing is important to target customers finding your item on the search engines.
    A. No keyword spamming. Keyword spam is the excessive repetition of keywords on a page and may raise a red flag to search engines. In particular, Googles has been known to de-list sites employing this technique or lower the ranking of sites that do this. To prevent spamming you are limited to 64 characters in your item title.
    B. Misspelled words appear unprofessional. Proof-read your listing and check for misspelled words.
    C. Don't fill your title with punctuations, symbols or all capital letters to draw attention to your listing. Text written solely in capital letters appears unprofessional, is visually tiring and detracts from the item itself.  If you're looking to attract serious buyers a few well-chosen words and good images will have better results.
    D. The item sub-title is to emphasize important information about your item. choose your words wisely for better results.
    E. Relevant Content: The item description should tell the reader about the item. Back To Top
Item Descriptions
Write informative descriptions. Items with good descriptions are found faster and sold for higher prices. State exactly what it is, what it's made of, and who made it. What makes your item special? What are the special features? Include hallmarks, makers mark, provenance if known, historical significance. What is the purpose of the item. Also include a condition report and item measurements. This is your opportunity to successfully sell your item.  More details help buyers make an informed purchase, and will give you an advantage over sellers who don't provide enough information. Very long descriptions will loose the buyers attention. Keep your descriptions precise, short and to the point.

    A. The item description should tell the reader about the item.
    B. Condition Report: Your item listings must contain information about the condition.
    C. Descriptions: Item descriptions should describe the item for sell. Items descriptions containing links, URL's, business names will be placed in the back-room immediately.
    D. All capitals should not be used. Capitalize the first letter of a word, but leave the rest lower case. This is a form of (implied) yelling on the internet .
    E. Item List Price: All items within your shop must have a price. Items without price or listed as $0.00/$5.00 etc. will be placed in the back-room. The shop owner will be notified by email. When an item is sold and the shop owner opts to keep the item displayed in their shop the price must remain at the actual sold price. Item Images
Good images are the most powerful selling tools on the Internet. Buyers are unable to touch or feel the item you list for sale and depend on good images when determining to purchase.

At the same time good item images are an important part of your business image and shows your potential clients that you're worthy of their trust and ultimately their business. Sellers who take the time to take good pictures and present them carefully reassure their buyers. Our customers have come to expect higher standards in quality as well as how the items are represented.

Item images must meet our quality control guide lines:
    A. All Images must denote an overall professional appearance.
    B. The main image must show the entire item listed for sale. Do not cut off any portion of the item.

    Luxury Sellers: All items must include images of the front, back, sides, interior as well as images of authentication. Item images must be actual pictures of the "actual" item for sale. Images taken from the Internet and displayed as your own are not acceptable and will be removed.
    D. All Images must be crisp, clear Any photograph that is blurred or does not meet our standards of photography will be automatically placed in the back room without prior notice. Once the image is corrected it may be re-listed.
    E. No watermarking on main image. Images can be watermarked on secondary images.
    F. Images must be free from distractive or cluttered backgrounds. The item is the focus not the background. Do not use distracting colors for your background.
    G. Exposure & Contrast: Good Item images should not be underexposed (too dark) or overexposed (too light). When photographing your item attempt to give the image a sense of dimension by using good light placement. For example; placing your main light at higher than the item and at 45 degree angle in reference to the item. Avoid using images that have too much contrast i.e. harsh shadows or too flat.
    H. Image Color Cast: Proper camera white balance take into account the "color temperature" of a light source. For example taking photographs in the shade will give your item a blue color cast and will not render the item its true color. Incorrect settings can create unsightly blue, orange, pink or even green color casts. Images with the previously mentioned color cast is not acceptable.
    I. Group Images: The main image refers to the main image (or your first image in your item listing) and is displayed throughout Malleries and is the larger image on the item page. . Secondary images are for the purpose of showing close-ups or different angles of the item. While it is acceptable to show an item grouping in your secondary or last image, a group image is not acceptable as your primary image. If items are a group image and not included in the listed price, the image must specifically state "Each sold separately".
    J. Symbols: Symbols such as copyright, arrows can be shown on item images.
    K. Other: Body parts in item images are not acceptable. Items that do not comply with this policy will be placed in the back-room.
    L. Other: Image borders can be no wider than 1px in width. In addition the border color must be approved. Items that do not comply with this policy will be placed in the back-room.
    M. Promotion: Malleries reserves the right to use any image for promotional purposes.
Use Of Auction Template:

Malleries Auction Template:
Shop owners who send items to auction and uses Malleries template must keep keep Malleries logo within the template. Items using the MALLERIES auction template without the MALLERIES logo will automatically be placed in the back room.
Sales Violations:

Reporting Sales:

All sales which are not reported via the Malleries shopping cart are considered the most serious violations thus a $150.00 fine is imposed upon any shop that violates the aforementioned policy. Failure to pay this fine, or a second violation of this policy will result in immediate suspension of your account. Once your shop is closed you will be required to reapply at the current shop fees and an additional registration fee will be required.

If an order must be canceled due to non-payment, the shop owner are required to enter the reason for the cancellation into the message of the order. NOTE: Malleries may contact customers who have cancelled orders.
Moving Sales Offsite:
Orders are not to be moved off site: The judiciousness behind this policy is twofold. Attempts to persuade buyers to conduct transactions off-site, erodes buyer confidence. Likewise, management and shop owners work diligently, as well as invest time and money in order to bring buyers into the Malleries site. Circumvention of this policy is counterproductive to our mutual objectives and will not be tolerated.

Items purchased by ebay visitor who purchases post auction and does not show as sold on eBay will be counted as a Malleries sale.

Layaways are considered a sale in the month the sale was generated. The shop owner will be charged a commission on the full selling price. Shop Policy: Accept layaways with balance due in 60 days.

Cancellation of A Layaway: If customer places an item on Layaway then cancels the commission is not refunded. We can refunds on layaways placed in the previous month.

Trial Period: Layaways are currently consider under beta testing / trial period
General Policy:
    A. All HTML Pages Must Be Approved: Html pages are for name branding purposes while at the same time remain within the Malleries standards. No blinking text, images must appear professional, no outbound links. If no prior approved or changes are made you must send an email to Malleries support for approval. After reviewing we will send an email letting the shop owner know. If denied the email will include the reasons.
    B. Outbound links are prohibited. You are not permitted to display a website URL or email address, anywhere in your listing (text or images). Violators of this policy are subject to membership review.
    C. Inbound Linking To Malleries: Inbound links are acceptable in the normal fashion. Linking to Malleries using code such as javascript hides the inbound link from the search engines and may cause confusion to viewers.

    D. Shop owners may not transmit unsolicited bulk or commercial messages via any form other than listing items for sale, displaying of items on layaway or sold items. Consignment Shop Owners will NOT advertise their consignment services on "item descriptions", "Images", via emails or receipts sent through Malleries software. Contacting Malleries shop owners to offer consignment services is prohibited.

    E. Beta Option / Trial Periods: In order to provide the best tools possible we are always open to suggestions. Should we receive a suggestion, we look at the possibility and research the option. The suggestion may or may not be instituted. At this time the new option is considered beta testing and in a trial period. During this trial period we attempt to work out any problems that we did not foresee. Hopefully the new option will work well, other times the new option will create too many problems. If at any point a new option is determined to cause too many issues it can be discontinued and no longer available for use.

    F. Linking to any page of Malleries via any Framing method is a serious copyright violation. Sellers do not purchase exclusive rights to Web pages on Malleries. Malleries may, in our sole discretion, and without your consent or payment to you, place third-party advertisements on any Web page within our site.
    G. Sellers do not purchase exclusive rights to Web pages on Malleries. Shop owners may not place third-party advertisements or any reference to other websites within on any page within Malleries.
    H. Malleries may, in our sole discretion, and without your consent or payment to you, place third-party advertisements on any Web page within our site.

Violation Of Policy:

Malleries reserve to reject any Seller membership applications. Malleries reserve the right to discontinue existing service to any Seller at our sole discretion. Services will be discontinued for unprofessional conduct or practices, buyer complaints, violations of policy and other issues which are considered to be disruptive to the business and the reputation of our Site.

Violations of our policy may result in a range of actions, including immediate account suspension. We may, at our sole discretion, restrict or terminate your access to your shop administration. When determining our course of action we first determine the seriousness of the violoation. Example of serious violations and reason for immediate suspension and or termination are as follows.

  1. The listing of a luxury item that is not authentic.
  2. Failure to report sales within the time period indicated by our Reporting Sales Policy.

When determining our course of action all previous violations, if any, will be considered. A typical proceedure is listed below. Note: All notices of violations are kept on record.

    Notice 1:
    This is your first notice that you are in violation of a policy. This notification will include further explanation and the action taken by Malleries. The shop owner is required to make the appropriate changes within a reasonable amount of time.
    Notice 2:
    If a shop owner continues to disregard a policy or the discrepancy is not corrected and continues to be in violation of policy, the shop owner will receive a second notification. At this time depending on the violaton action will be taken.
    Notice 3:
    Notification that your account has been placed under suspension and no longer viewable by the public. Suspension can be indefinate.

    In the event a seller account is suspended, the seller may be required to pay a $150.00 fine before the shop will be re-opened. In the event a seller account is suspended or terminated, any amounts due on your Seller account will immediately become due and payable. If your sellers account has been canceled we do not forfeit fees paid. In most cases the following procedure will apply.

Shop Fees

All fees are quoted in U.S. Dollars. Payment forms include Visa or Mastercard. Paypal is not accepted. All shop owners are required to keep a valid credit card on file. It is the shop owners responsibility to keep the payment information up to date. A new shop applicant is required to pay an application fee in the amount stated on the sellers page. If collection of application fee fails the shop administration will not be accessible.

Monthly Billing:
All shop fees and applicable taxes associated are charged on the 1st of each month. If our payment attempt fails will be considered in past due status and a $20 late fee will be accessed in addition to monies owed.

If after the 5th of the month, shop owners who shop fee payment is not current, the shop may be placed under suspension (not viewable by the public). If after 30 days a shop who is placed under suspension due to non payment is required to go through the opening process including paying opening shop fee.

We may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 60 days past due).

Luxury Shops:
All luxury shop owners must agree to a fees before their shop can go live. Circumventing Malleries Checkout: Malleries customers may contact shop owners to ask questions about items listed within your shop. If a sale is agreed upon the shop owner is to encourage the buyer to purchase the item via Malleries checkout. At times the buyer may prefer to purchase by phone. It is the shop owners responsibility to purchase the item via Malleries checkout. Shop owners who are found guilty of circumenventing Malleries checkout in order to avoid paying commission will immediatly be placed under suspension. At this point current customers will be notified of the seller shop closing.

Closing Your Shop:
Shop owners are required to give a notice at minimum 10 days before the beginning of the next month. To close your shop use our Contact Us form. Include the following information: Your Shop Name, Your Name, e-mail address and the reason for closing. Back To Top
